Expansion Worker Visa in the UK
On April 11, 2022, the UK Home Office officially launched the UK Expansion Worker Visa as a replacement for the Sole Representative Visa. This visa is applicable for overseas companies looking to establish a branch office in the UK and send employees to work there. It falls under the category of a short-term work visa, initially issued for one year with the possibility of a one-year extension.
To be eligible, certain prerequisites must be met, including registering a UK company and leasing physical office space. However, the company should not engage in actual business activities. The UK company will apply for a Certificate of Sponsorship to guarantee the applicant's visa application. Compared to the previous Sole Representative Visa, language requirements have been removed, and the direct pathway to permanent residency has been eliminated. However, it is possible to switch to a Skilled Worker Visa to apply for permanent residency at a later stage. Spouses and dependent children who meet the requirements can apply for a dependant visa.
UK Expansion Worker Visa Application Requirements
1. The applicant must be at least 18 years old
2. The applicant should have a minimum of one year of managerial experience
3. If the applicant and spouse are not major shareholders of the company, holding company shares is not required. If shares are held, the combined shareholding of the couple should not exceed 30%
4. The applicant should have been employed by the overseas company for at least one year and have an annual salary of at least £42,400
5. Maintenance funds: The applicant must demonstrate personal savings with a minimum balance of £1,270 in their bank account for 28 consecutive days within the past month
6. The applicant must provide a clear criminal record certificate and be free from tuberculosis
7. Accompanying dependents:
(1) Spouse
(2) Children under 18 years of age, as well as children over 18 years of age living in the UK and financially dependent on the main applicant
Requirements for the overseas company (parent company):
1. The parent company should have been established for at least three years and have overseas business operations
2. The annual turnover in the past year should be at least £5 million
Requirements for the UK subsidiary company:
1. The subsidiary company must be registered and hold a valid business license
2. The subsidiary company should have a genuine physical office
3. The subsidiary company should not have engaged in any business transactions
4. The subsidiary company should possess a Certificate of Sponsorship (A-Rating)
UK Expansion Worker Visa Renewal Conditions
1. The applicant must still be employed in the same position by the UK subsidiary company
2. The applicant must still be employed by the same employer
3. The total duration of stay in the UK has not reached the maximum period allowed (2 years)
4. The applicant must have maintained a clean criminal record during their stay in the UK
